Setbacks (kuja) from buildings, wells and boundaries"},"content":{"rendered":"<p>You have found a spot for the tank, but how far must it be from the house, the well and the neighbour&#8217;s fence? There is no single sewage holding tank setback Estonia-wide. The national regulation on setbacks (<em>kuja<\/em>) does not cover sealed holding tanks (Estonian: <em>reoveemahuti<\/em> or <em>kogumismahuti<\/em>; UK readers may know one as a cesspool or cesspit). Your municipality may set a setback in its own wastewater rules, and those rules differ. This article explains who sets <em>kuja<\/em> and how to find your municipality&#8217;s rule, then covers wells, boundaries and buildings, the manufacturer&#8217;s requirements, tanker access, and a checklist for the building notice (<em>ehitusteatis<\/em>).<\/p>\n<h2>What is <em>kuja<\/em>, and who sets it for a holding tank?<\/h2>\n<p>A holding tank only stores wastewater until a tanker pumps it out: no treatment, no outlet. The Water Act (<em>Veeseadus<\/em>) requires it to be leak-tight (\u00a7 124(2)). It is not a septic tank (<em>septik<\/em>), which settles solids and needs an infiltration field.<\/p>\n<p><em>Kuja<\/em> is a setback. The Water Act defines it for sewerage facilities as their smallest permitted distance from homes, certain other buildings people use &#8220;and from a dug well and drilled well&#8221;. It is measured from the structure&#8217;s outer contour (\u00a7 134(1) and (4); the official English translation calls it &#8220;clearance&#8221;).<\/p>\n<p>The detailed distances are in Minister of the Environment Regulation No 31 of 31 July 2019, which covers treatment plants, pumping stations and tanker reception points. For small own treatment plants (<em>omapuhasti<\/em>) it says: &#8220;the <em>kuja<\/em> of a septic tank or other closed-top or underground own treatment plant is at least 5 m&#8221; (\u00a7 5(1) p 2, our translation; Estonian: <em>\u201eseptiku v\u00f5i muu pealt kinnise v\u00f5i maa-aluse omapuhasti kuja on v\u00e4hemalt 5 m&#8221;<\/em>). The regulation never mentions holding tanks. Keskkonnaamet (the Environmental Board) states the consequence in its handbook for municipalities:<\/p>\n<blockquote>\n<p><em>\u201eReovee kogumismahuti on reovee kohtk\u00e4itluss\u00fcsteem, mis ei kuulu m\u00e4\u00e4ruse nr 31 reguleerimisalasse. Reovee kogumismahuti kuja ulatuse n\u00f5ude v\u00f5ib kohalik omavalitsus kehtestada veeseaduse \u00a7 104 l\u00f5ike 7 alusel reovee kohtk\u00e4itluse ja \u00e4raveo eeskirjaga.&#8221;<\/em><\/p>\n<p>Our translation: &#8220;A wastewater holding tank is an on-site wastewater system that does not fall within the scope of Regulation No 31. The local authority may set a requirement for the extent of a holding tank&#8217;s <em>kuja<\/em> under Water Act \u00a7 104(7) through its rules for on-site wastewater treatment and removal.&#8221;<\/p>\n<\/blockquote>\n<p>Water Act \u00a7 104(7) reads: &#8220;Local authorities shall establish rules for on-site treatment and transport of wastewater in their administrative jurisdiction&#8221;. That is the official English translation; only the Estonian text has legal force. Some municipalities set a holding-tank <em>kuja<\/em> in those rules and some do not, and the figures differ. The Water Act&#8217;s zones around wells apply either way.<\/p>\n<h2>How to find your municipality&#8217;s rule<\/h2>\n<ol>\n<li><strong>Title:<\/strong> usually <em>Reovee kohtk\u00e4itluse ja \u00e4raveo eeskiri<\/em> (rules for on-site wastewater treatment and removal), sometimes with the municipality&#8217;s name added.<\/li>\n<li><strong>Search<\/strong> the official gazette, Riigi Teataja (riigiteataja.ee), for the title and your municipality. Municipal regulations have references starting &#8220;RT IV&#8221;.<\/li>\n<li><strong>Check<\/strong> the issuer (<em>V\u00e4ljaandja<\/em>) and the status: <em>hetkel kehtiv<\/em> (in force), not <em>kehtetu<\/em> (repealed). Results mix both, and we found several repealed rules while researching this article.<\/li>\n<li><strong>Search the text<\/strong> for <em>kogumismahuti<\/em>, <em>kuja<\/em>, <em>kaev<\/em> (well), <em>hooldusala<\/em> (maintenance zone), <em>naaberkinnistu<\/em> (neighbouring plot) and <em>juurdep\u00e4\u00e4s<\/em> (access).<\/li>\n<li><strong>Ask<\/strong> the municipality in writing if the rule is silent or unclear. No figure for the <em>kuja<\/em> itself.<\/td>\n<td><a href=\"https:\/\/www.riigiteataja.ee\/akt\/429012019023?leiaKehtiv\" target=\"_blank\" rel=\"noopener\">RT IV, 29.01.2019, 23<\/a>, \u00a7 5(2)<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/figure>\n<p>Municipal rules are amended from time to time, so always open the version in force before you plan.<\/p>\n<h2>Wells, neighbours and buildings: what to check<\/h2>\n<h3>Wells<\/h3>\n<p>The Water Act gives every dug well (<em>salvkaev<\/em>), and every drilled well (<em>puurkaev<\/em>) abstracting under 10 m\u00b3 a day, a <strong>10 m maintenance zone<\/strong> (<em>hooldusala<\/em>; &#8220;maintenance area&#8221; in the official translation). Inside it, &#8220;construction of a sewerage or wastewater collecting system&#8221; is prohibited (\u00a7 154(1), (3) and (5) p 7, official translation). Groundwater intakes abstracting 10 m\u00b3 a day or more have a sanitary protection zone (<em>sanitaarkaitseala<\/em>) of 10, 30 or 50 m, depending on the intake&#8217;s size and how well the aquifer is protected (\u00a7 149(1)\u2013(2)). Five of the seven rules above keep holding tanks out of these zones.<\/p>\n<ul>\n<li><strong>Count neighbours&#8217; wells.<\/strong> Their zones can reach onto your plot.<\/li>\n<li><strong>Overlaps are measured differently.<\/strong> Saaremaa&#8217;s web page applies the stricter requirement where a tank&#8217;s 5 m <em>kuja<\/em> overlaps a well&#8217;s zone, so there a tank must be at least 10 m from a well with a 10 m zone. Viru-Nigula&#8217;s rule says the <em>kuja<\/em> must not reach into the zone at all. Ask how your municipality measures.<\/li>\n<li><strong>Downslope is better.<\/strong> Keila and Saue require it.<\/li>\n<li><strong>Figures of 50 m or 60 m<\/strong> from a well apply to discharging treated effluent into the ground (Water Act \u00a7 127(1); Keskkonnaamet handbook; some municipal rules), not to a sealed tank.<\/li>\n<\/ul>\n<h3>Neighbouring plots<\/h3>\n<p>The national provisions cited here set no boundary distance for holding tanks, but some municipalities do: 5 m in Keila and 2 m in Kohila, both less by agreement. Put any agreement in writing. The authority may also involve neighbours when it processes your building notice (Building Code, <em>Ehitusseadustik<\/em>, \u00a7 36(5)).<\/p>\n<h3>Buildings<\/h3>\n<p>Any distance to buildings comes from the municipality (5 m in T\u00f5rva and Saaremaa). The definitions do not say whose buildings count, so measure to your neighbours&#8217; buildings too. For your own house, the ministry guide ties the tank&#8217;s depth to the building&#8217;s sewer pipe, and the order drawing allows an inlet depth of up to 1 500 mm, so have a designer check a long pipe run.<\/p>\n<h2>Manufacturer&#8217;s requirements: safety zone, traffic load, several tanks<\/h2>\n<p>Vesmaco&#8217;s <a href=\"https:\/\/reoveemahutid.ee\/wp-content\/uploads\/2024\/02\/vesmaco-installation-tank-ee.pdf\">installation guide<\/a> (in Estonian, 2016, written &#8220;according to EN 976-2&#8221;) sets these placement conditions. It also states that the warranty does not apply if its instructions are ignored.<\/p>\n<ul>\n<li><strong>Green area:<\/strong> accidental driving onto the tank must be ruled out, and the safety zone (<em>ohutsoon<\/em>) is 1 m larger than the tank in every direction. For an MK-5 D1400 (about 3.6 m \u00d7 1.4 m) that is about 5.6 m \u00d7 3.4 m. Take exact dimensions from the drawing for your model.<\/li>\n<li><strong>Traffic or parking area, or deeper than 1.5 m:<\/strong> a reinforced-concrete slab at least 15 cm thick, at least 50 cm above the tank and 50 cm wider on every side, plus a hatch class that suits the load.<\/li>\n<li><strong>Several tanks:<\/strong> at least 50 cm apart.<\/li>\n<\/ul>\n<p>The Ministry of the Environment&#8217;s 2015 guide says a holding tank &#8220;must not be installed under a road or parking area&#8221; (our translation), and the emptying truck must not drive over it. Avoid traffic areas if you can; otherwise you need a designed solution (see <a href=\"\/en\/holding-tank-under-driveway\/\">can a holding tank go under a driveway?<\/a>).<\/p>\n<p>A municipal <em>kuja<\/em> is measured from the same outer contour: 5 m around an MK-5 D1400 covers roughly 13.6 m \u00d7 11.4 m. For tight plots, see <a href=\"\/en\/holding-tank-small-plot\/\">holding tanks for small plots<\/a>; all 19 models are listed in the <a href=\"\/en\/#mudelidjajoonised\">model table<\/a>.<\/p>\n<h2>Tanker access and hatch position<\/h2>\n<p>All seven rules in the table require access for the emptying vehicle, and six of them refer explicitly to year-round access or emptying. Saaremaa&#8217;s page suggests placing the tank near the access road. The ministry guide says to keep access open in every season and keep the truck off the tank.<\/p>\n<ul>\n<li><strong>Hose reach:<\/strong> ask the company that does the emptying (<em>purgimine<\/em>) how far and how high its hose reaches from where the truck can stand.<\/li>\n<li><strong>Riser:<\/strong> the standard is a PVC D200 riser, 500\u20131 000 mm high, with a plastic cover. A D400 or D600 riser and an EN 124 hatch (A15 to D400) are options. Check on the drawing for your model where the riser sits, and position the tank so the riser is within hose reach and away from wheels.<\/li>\n<li><strong>Level alarm:<\/strong> with the wireless Tank-Check RF-431, test the link if the receiver is over 70 m away or buildings are in the way.<\/li>\n<\/ul>\n<p>Route planning is covered in <a href=\"\/en\/tanker-access-holding-tank\/\">tanker access<\/a>.<\/p>\n<h2>Location checklist before filing the building notice<\/h2>\n<ol>\n<li>The rule in force is found and its location clauses noted.<\/li>\n<li>A site plan is drawn to scale, showing buildings, every well within reach with its zone (yours and your neighbours&#8217;), boundaries, driveway and access road, and the tanker&#8217;s standing place.<\/li>\n<li>The tank is drawn at real size, and distances measured from its outer contour (not the hatch) meet your municipality&#8217;s rule, including well-zone overlaps.<\/li>\n<li>The 1 m safety zone stays free of traffic, or there is a designed slab. Tanks are at least 50 cm apart.<\/li>\n<li>The tanker&#8217;s standing place is usable all year, hose reach is confirmed, and the truck never drives over the tank.<\/li>\n<li>The inlet depth is known (maximum 1 500 mm). Where cover is less than about 1.3 m, insulate (ministry guide).<\/li>\n<li>Neighbours&#8217; written agreements and the municipality&#8217;s written answers are kept on file.<\/li>\n<\/ol>\n<p>Then file the building notice (<em>ehitusteatis<\/em>) in the building register (<em>ehitisregister<\/em>, ehr.ee) at least 10 days before work starts. The paperwork is covered in <a href=\"\/en\/holding-tank-rules-estonia\/\">holding tank rules in Estonia<\/a>.<\/p>\n<h2>Frequently asked questions<\/h2>\n<p><strong>How far must a holding tank be from the house?<\/strong> There is no national figure; your municipality&#8217;s rule decides. T\u00f5rva and Saaremaa, for example, use 5 m, while Harku and Saue give no figure. If your rule is silent, ask the municipality in writing.<\/p>\n<p><strong>May the setback zone extend onto a neighbour&#8217;s plot?<\/strong> That depends on the rule. Keila requires 5 m from the boundary and Kohila 2 m, and both allow less by agreement. Get any agreement in writing. A neighbour&#8217;s well zone can also reach onto your plot.<\/p>\n<p><strong>How far from a drinking-water well?<\/strong> The Water Act&#8217;s 10 m maintenance zone around dug wells and small drilled wells prohibits building a wastewater collecting system. Larger groundwater intakes have sanitary protection zones of 10\u201350 m. Your municipality may add to this or measure overlaps differently: Saaremaa&#8217;s web page, for example, asks for at least 10 m from a well with a 10 m zone. Count neighbours&#8217; wells too.<\/p>\n<hr \/>\n<p><strong>Once the position is fixed, send the inlet depth and the cover conditions.<\/strong> In the <a href=\"\/en\/#order\">quote form<\/a>, tell Vesmaco how deep the pipe reaches the tank, whether the tank lies under grass or near traffic, and where the tanker will stand.
